The organizer reserves the right to change the start and duration of the trade fair without the exhibitor being able to derive any claims against the organizer (e.g. withdrawal, compensation).

2. registration and terms of payment

Registration for theKlimaZukunftas an exhibitor is made using the stand booking form. The contract between exhibitor and organizer is concluded upon submission of the completed and signed registration form, confirmed by the organizer.

The prices for stands can be found on the Price List form. Additional extras (tables, showcases, exhibition walls, etc.) can be ordered via the exhibitor portal.

The organizer reserves the right to withdraw from the contract if the exhibitor does not meet his payment obligations on time. All payments shall be made in euros to the organizer's account.

If the payment deadline stated on the invoice is exceeded, interest on arrears will be charged at the usual bank rate. Transfer charges shall be borne by the exhibitor. Exhibitors from abroad are also obliged to pay the value added tax to be charged. The Austrian General Civil Code (ABGB) including ancillary laws shall apply; the UN Convention on Contracts for the International Sale of Goods and IPR shall be excluded.

After registration, 50% of the total amount will be invoiced, the remaining 50% is due 12 weeks before the event.

Our General Terms and Conditions and the right of withdrawal enshrined therein apply, with corresponding cancellation costs.

3. exhibitor passes

Depending on the size of the stand, a number of exhibitor passes are available to the exhibitor. Additional passes will be charged at the advance ticket price.

Exhibitor passes must be collected from the exhibition office prior to the start of stand construction work and must be worn visibly throughout the fair and presented at the request of security staff.

4 Stand construction

4.1 Terms of use

The stands used are the property of the stand construction company commissioned by the organizer, therefore any processing or modification of the stand construction elements is prohibited. This applies in particular to nailing, screwing, welding and gluing as well as painting over and wallpapering. Any adhesive residue must be removed by the exhibitor. The exhibitor shall be liable for loss of or damage to the objects used, including by third parties, up to the replacement value.

4.2 Stand

Assembly and dismantling The exact times and the exact organization of assembly and dismantling as well as delivery and collection will be announced to the exhibitor in good time by the organizer. Should the organizer still have outstanding claims against the exhibitor at the time of stand construction, the organizer is entitled to prohibit stand construction until payment has been made. It is expressly forbidden to set up or dismantle stands during the opening hours of the fair. In the event of non-compliance, an amount of EUR 500 will be charged.

4.3 Occupancy of the stand

The stand must be set up and furnished by 12:00 noon on the day before the trade fair. If this deadline cannot be met, the exhibitor must inform the organizer in writing. If no notification is received by the above deadline and the space is not occupied, the organizer reserves the right to dispose of the space elsewhere from this time onwards without further notification and without reimbursement of any costs to the previous stand tenant. Stand construction must be completed by 12:00 noon on the first day of the fair. The rented stand must be occupied during the entire opening hours of the fair. Changes to the allocated space and changes to the outer walls of the stand are not permitted without prior approval from the organizer.

4.4 Changing the size and position of a stand

The organizer reserves the right to change the location and / or size of the stand at short notice, e.g. due to official instructions.

4.5 Exceeding the construction height

Exceeding the permitted construction height for exhibition stands beyond the standard dimension of 2.5 m by means of superstructures, lettering and decorations of any kind requires the written approval of the organizer. If it is intended to erect a superstructure, the corresponding plans or structural analysis reports must be submitted to the organizer no later than 6 weeks before the start of the trade fair. The organizer reserves the right not to grant approval for superstructures of any kind exceeding the standard height of 2.5 m. The prices for the superstructure will be calculated according to width and height and communicated after submission of the plans and documents. If the exhibitor uses his own stand material, the Austrian regulations for exhibition stands (B1, fire protection) must be complied with and partition walls must be erected to separate the stand from other stands. The exhibitor undertakes to comply with Austrian regulations in the form of laws or ordinances as well as police and safety regulations.

4.6 Joint stands

If several exhibitors share a stand, the main exhibitor assumes joint liability (regarding payment, damage, etc.). The main exhibitor is responsible for passing on all information to his co-exhibitors. A flat rate will be charged for each co-exhibitor according to the valid price list. Co-exhibitors are listed in the trade fair magazine, but do not receive their own stand signage.

5 Cancellations and withdrawal

5.1 Cancellations

The organizer reserves the right to cancel the already organized trade fair in cases of force majeure. In this case, 50% of the payments received up to the date of cancellation, less the costs/expenses already incurred by the organizer due to orders placed by the exhibitor, will be refunded. The exhibitor shall not be entitled to any compensation.

5.2 Withdrawal by the exhibitor

The exhibitor must declare his withdrawal in writing and have it confirmed in writing by the organizer. In the event of withdrawal up to 3 months before the start of the trade fair, 50% of all costs shall remain due for payment. In the event of withdrawal within 3 months before the start of the trade fair, the entire amount is due for payment, plus taxes, duties, other ancillary costs and any costs already incurred for ordered technical equipment and services. The exhibitor is not entitled to assign claims arising from the exhibition contract with the organizer to third parties. Even partial transfer of the stand requires the express written consent of the organizer and is only permitted against payment of a co-exhibitor fee.

The exhibitor acknowledges that the cancellation fee must also be paid if the organizer succeeds in renting or selling the exhibition stand to a third party. This does not affect the right to claim compensation for damages in excess of the agreed cancellation fee. The due date for the cancellation fee plus any additional payments shall be based on the cancellation invoice.

6 Sale and giving away

The exhibitor undertakes not to exhibit, sell or give away illegal substances of any kind. In the event of non-compliance, the exhibitor will be removed from the fair and will bear all costs for any consequential damage. There will be no reimbursement of costs. The sale of food and beverages for immediate consumption is not permitted.

7 Advertising and music

Advertising is only permitted in your own stand area. Any other advertising (putting up posters and stickers, hanging up flags and balloons, distributing magazines, flyers or other advertising material) is subject to a charge and may only be carried out with the approval of the organizer. All advertising material must be removed at the end of the trade fair. If this is not done, cleaning will be charged at cost. Playing music on your own music system is not permitted. The sound system is provided centrally by the organizer.

8 Safety, liability, insurance

The stand rental does not include insurance for the objects brought into the stand, the stand and all other exhibition equipment. If insurance is taken out with the organizer or an insurance company, the terms and conditions agreed separately in writing when the insurance is taken out shall apply. The organizer accepts no liability for damage, theft or robbery of vehicles, exhibited installations and goods. Each exhibitor is responsible for the supervision of his stand during the set-up and dismantling periods and during the trade fair. Each exhibitor shall be liable for damage to objects and persons caused to the organizer by himself, his employees or agents through acts or omissions, and shall indemnify the organizer for all costs, damages and interests claimed by third parties from the organizer as a result of acts or omissions by the exhibitor, his employees or agents.

9. security

The organizer shall provide general security for the event areas during the trade fairs (including set-up and dismantling times), without, however, assuming any liability for loss or damage to objects. The exhibitor is responsible for monitoring and supervising the stand area and stand. This also applies during the set-up and dismantling periods, before the start and after the end of the event. Exhibitors have no legal claim to separate stand security (theft protection). Additional stand security services must be commissioned separately by the exhibitor and charged directly to the company commissioned. Any stand security commissioned separately by the exhibitor must be notified in writing to the organizer in good time, stating the details of the security company, insofar as it takes place during the opening hours of the exhibition halls. The use of third-party security companies commissioned by the exhibitor to guard the stand outside the opening hours of the exhibition center also requires the prior written approval of the organizer.

10 Cleaning

The organizer shall be responsible for cleaning the grounds and the aisles in the halls. Exhibitors are responsible for cleaning their stands. Stand cleaning shall be carried out by cleaning companies approved by the organizer at the exhibitor's request and expense. Packaging material and waste that the exhibitor throws into the aisle or puts to one side will be removed at the exhibitor's expense. The disposal of hazardous waste must be arranged by the exhibitor himself.

11 Transportation and parking

Driving into the exhibition halls with motor vehicles of any kind whatsoever is strictly prohibited during the trade fair. For special transports, written permission must be obtained from the organizer in good time. All vehicles must be removed from the entrances, driveways, fire department zones and press parking areas without restriction from the end of the set-up period. Trucks over 3.5 tons may not be parked in the parking lots during the trade fair. Any infringement will result in a case of disturbance of property and the organizer is free to have illegally parked vehicles towed away at the expense of the vehicle owner.

12 Complaints

Complaints must be reported immediately to the organizer at the exhibition office.

13. smoking ban

Smoking is generally prohibited in the exhibition halls. Smoking is only permitted in the designated and marked areas. The exhibitor is also liable for compliance with the smoking ban by visitors to his stand area. Should visitors violate the ban, this must be reported to the organizer's staff immediately. The exhibitor is liable for all damages incurred by the organizer due to non-compliance with the smoking ban.

14. house rules

The house rules of the MARX HALLE and the organizer must be followed.

15. written form, customary law

Amendments, supplements and additions must be made in writing. This also applies to any deviation from the written form. Verbal collateral agreements are invalid. The exhibitor may not derive any rights whatsoever from previous events or contracts.

16. filming and photography

The organizer is granted the right to photograph and film on the event grounds and to use the images for his own or general publications. In this context, the exhibitor waives all objections arising from industrial property rights, in particular copyright and the law against unfair competition (UWG). The exhibitor is not permitted to make or have made films, photographs, drawings or other illustrations of exhibits and exhibited goods outside his own stand.

17 Declaration of consent in accordance with the Data Protection and Telecommunications Act

The exhibitor consents to the use of the data provided in the registration form. Exhibitor data is used for the purpose of marketing the event. Withdrawal of consent is possible at any time and will render further use of the data inadmissible. The exhibitor agrees - subject to revocation at any time - to be informed in future by the trade fair organizer about trade fair events by e-mail or post.

18 Miscellaneous

Persons under the age of 10 may only be admitted if accompanied by a parent or guardian. Bringing illegal substances, weapons - as well as all objects that can be used for acts of violence - and animals is prohibited. Checks will be carried out at the entrance and within the exhibition grounds, which will result in a ban on entry or the removal of the person from the exhibition grounds in the event of a violation. There will be no reimbursement of costs.

19 Place of jurisdiction

Austrian law shall apply exclusively. Vienna is agreed as the place of jurisdiction.
